Podle nově účinné právní úpravy novely bude od 1. 1. 2021 nezbytné, aby společnosti využívající k ověření totožnosti podle AML zákona naše KYC API věděly, kdo provedl fyzické ověření daného člověka.
Abychom společnostem, které naše identitní služby využívají, umožnili požadavek zákona naplnit, přidáme v listopadu do našeho KYC API nový atribut „physicallyIdentified“. Tento atribut může nabývat hodnoty „true“ nebo „false“. Aktualizovanou technickou dokumentaci najdete na adrese https://www.airbank.cz/api/kyc.
Je důležité vědět, že pokud při předání informací o klientovi bude v atributu „physicallyIdentified“ hodnota „false“, znamená to, že jsme klienta osobně neviděli. Jeho identitu tudíž nebude možné z pohledu AML zákona považovat za prokázanou.
A new function will be added to our KYC API in response to an amendment to the Act on Certain Measures against Money Laundering and Terrorist Financing (AML Act) starting on 1 January 2021.
Starting on 1 January 2021, the amended law will require businesses using our KYC API for identity verification as per the AML Act to know who has carried the physical identification of the identified person.
To allow businesses using our identification service to comply with the law, we will add a new attribute, „physicallyIdentified“, to our KYC API in November. This attribute can have the values „true“ or „false“. An updated version of the technical documentation is available at https://www.airbank.cz/api/kyc.
Note that if the value of the „physicallyIdentified“ attribute is „false“ at the time client data are delivered, it means that we have not identified the client in person. Consequently, the client’s identity cannot be considered verified in terms of the requirements of the AML Act.
